The sentencing of a failed congressional candidate who pleaded guilty to paying twice-convicted former Gov. John G. Rowland off the books during her 2012 campaign has been delayed indefinitely while a federal judge considers a complaint that prosecutors withheld evidence from Rowland's lawyers.

Lisa Wilson-Foley, a Simsbury Republican who sought the 5th District congressional seat had been scheduled to appear Tuesday in New Haven federal court as part of a plea deal in the successful prosecution of Rowland.

But "in light of the issues" raised by Rowland's lawyers in a Jan. 2 filing, U.S. District Court Judge Janet Bond Arterton decided Sunday to postpone Wilson-Foley's sentencing as she previously did with Rowland's sentencing.

The delay is the fifth postponement in under two weeks for Wilson-Foley, who faces up to a year in prison for illegally funneling $35,000 in political consulting fees to Rowland through her husband's nursing home business, Apple Rehab.

Sentencing has been delayed for former governor John Rowland.

 

Rowland’s defense lawyers had requested that the hearing be put off.

 

They argued that there was new information in a court filing by lawyers for one of his conspirators, former fifth district congressional candidate Lisa Wilson-Foley.

Rowland’s defense team argued that if they had the information in the Wilson-Foley paperwork, they might have called her to the stand during the former governor’s trial.

 

Rowland was convicted of using a sham contract to get paid through Wilson-Foley’s husband’s nursing home chain, for work the former governor was really doing for Wilson-Foley’s campaign.

NEW HAVEN -- Ex-governor and ex-convict John Rowland stood emotionless, stoically clinging to his wife's hand as the verdict was read aloud Friday at 2:40 p.m.

Each time the jury foreman pronounced the word "guilty" as charged -- seven times in all -- uncontrollable sobs followed from his wife, Patty, and other family members in U.S. District Court.

When the last "guilty" rang out and another sob was stifled, Rowland faced a second term in federal prison.

The 12-member jury deliberated for just seven hours before convicting the 57-year-old one-time Republican wunderkind on the seven charges stemming from violations of federal election laws during the 2010 and 2012 Republican 5th Congressional District nomination campaigns.

"The guy just doesn't learn," said Joseph Merly, a local civil rights and criminal defense lawyer who watched parts of the 13-day trial. "But then again, he's the product of Waterbury politics. Now he's the poster boy for Waterbury political corruption."
